Blu Homes, Inc. (Waltham, MA) has sued Michelle Kaufman Studio (Novato, CA) and other entities for copyright and trademark infringement, breach of contract, tortious interference and other claims.  Kaufman is an architect and designer of prefabricated green homes.  Blu builds and markets this type homes.

The complaint alleges that Kaufman created a series of Intellectual Properties assets that were eventually purchased by Blu.  Those assets included both architectural designs as well as trademarks including MICHELLE KAUFMAN DESIGNS.   

A later consulting agreement between Kaufman and Blu indicated that Blu owned the rights in the resulting works.  The agreement also called for Kaufman not to work with anyone else for nine months following completion of the relationship. 

Some former Kaufman employees then founded their own studio, soliciting customers in competition with Blu.  They then began advertising designs purportedly owned by Blu, leading to confusion in the marketplace.  The complaint alleges that Kaufman helped them, in breach of the agreement and in violation of Blu’s rights.

Coach, I bet you were laughing when you wrote this one. We all know how much you admire Michelle and the wonderful work she has done in creating the prefab industry. LMAO

I wish Blu Homes all the best in their lawsuit against MK Designs. I agree with Coach. She needs to be knocked down a peg or two.
